For the purposed of this agreement,
“BREEDER” shall refer to Roxanne Ellsworth, Goldenridge Kennels,
1381 Kennebec Road, Hampden, Maine 04444. “GOLDEN RETRIEVER”
shall refer to the puppy identified above and “GUARDIAN” shall
refer to the individual(s) identified above.
The following terms and conditions apply:
1. The BREEDER guarantees
that the GOLDEN RETRIEVER has been examined by a veterinarian
and found to be healthy and free of parasites.
2. This puppy is being placed under Guardian ship program it
will not be spayed at the time of delivery. The following
conditions apply to the Guardian portion of the agreement:
a. The GUARDIAN agrees to
allow the puppy to have (2) litters for the breeder (three of
more puppies constitutes a litter and if less than three puppies
are born the BREEDER shall be entitled to one additional
litter.) Once two litters have been born the BREEDER shall have
the GOLDEN RETRIEVER” spayed at the breeders expense and full
ownership rights shall be turned over the GUARDIAN.
b. The GUARDIAN understands that the first breeding will take
place after or about one year of age upon completion of
appropriate genetic testing and that the GOLDEN RETRIEVER will
only be bred with the approval of a qualified Veterinarian.
c. The BREEDER shall be responsible for the cost of all health
testing (X-rays, eye certification, and heart certification) and
all expenses related to breeding including veterinary fees and
semen shipping costs.
d. The GUARDIAN is responsible for normal costs associated with
pet ownership such as food, booster shots and pet license,
however the BREEDER agrees to pay a maintenance sum $300 per
litter to assist with these costs. The Guardian agrees to
use the services of an approved Veterinarian for all vet care .
The breeder shall provide transportation to all vet appointments
related to breeding with the exception of blood progesterone
levels which are time sensitive and will require the GUARDIAN to
transport to any vet on the say requested for a blood draw.
e. The GUARDIAN is responsible for the costs of vet care arising
out of negligence, lack of supervision or general life events
which are not genetic in nature (i.e.: poisoning, ingestion of
foreign objects, skeletal trauma, viral illness etc)
f. The GUARDIAN agrees to make the “GOLDEN RETRIEVER” available
for health testing and breeding at the appropriate times,
usually with several days notice, but on rare occasions, with as
little as 12-24 hours notice.
g. The GUARDIAN is responsible for keeping the “GOLDEN
RETRIEVER” adequately contained and supervised during heat
cycles and to inform the BREEDER immediately upon the start of
any heat cycle. If they so desire, the GUARDIAN may opt to have
the “GOLDEN RETRIEVER” stay at the breeder’s home during heat
cycles.
h. The BREEDER reserves the right to make all breeding decisions
including choice of stud, method of breeding and mid term
ultrasounds or end of term x-rays. The final decision for all
sales shall rest with the BREEDER
i. The adult “GOLDEN RETRIEVER” shall be delivered to the
breeders house one week before her due date and shall remain
with the breeder until the pups are 6-8 weeks of age and then
the “GOLDEN RETRIEVER” shall be returned to the GUARDIAN family.
The GAURDIAN family shall be permitted to visit the “GOLDEN
RETRIEVER” weekly during this period provided they take
requested precautions to ensure the puppies safety. The GUARDIAN
family shall be the only persons permitted to visit and shall
not be permitted to bring kids friends, extended family etc to
visits.
j. All puppies whelped shall be the sole property of the BREEDER
and the GUARDIAN shall be not be entitled to any financial
interest or ownership of the puppies. If the GUARDIAN chooses to
take a puppy for their own family, they may do so in lieu of
their sum total of maintenance payments. The GUARDIAN is not
entitled to a puppy in lieu of payment for the purposes of
reselling it.
k. The BREEDER agrees that no puppies shall ever be sold to a
pet store, broker or research lab.
l. If for some reason the “GOLDEN RETRIEVER” is unable to
conceive for multiple cycles or does not pass testing of the
eyes, heart and hips then the GUARDIAN shall have the option
keeping it as a spayed family pet or returning it to the
BREEDER. In such an instance the deposit shall be retained and
used to cover the cost of spay procedure.
m. Should the GUARDIAN breed the puppy at any time without
permission or allow it to be bred unsupervised during a heat
then the BREEDER shall have the right to repossess the “GOLDEN
RETRIEVER” and the agreement shall be null and void. Further all
pups produced from such breeding shall be the sole property of
the BREEDER.
n. Should the GUARDIAN have the puppy spayed without the express
written permission of the BREEDER, damages payable in the amount
of $9000 plus legal fees shall be payable to the BREEDER and
physical possession shall be returned to the BREEDER
immediately.
o. The GUARDIAN shall inform the BREEDER in advance of taking
any extended trips (over 5 days duration) with the “GOLDEN
RETRIEVER”. Should the timing of a vacation fall during a time
when a heat is anticipated the GUARDIAN shall bring the “GOLDEN
RETRIEVER” to board with the BREEDER at no cost for the duration
of their absence.
p. The breeder may, at their discretion, offer to board the
GOLDEN RETRIEVER during holidays but cannot guarantee this and
the guardian home is encouraged to find safe boarding
arrangements or a pet sitter for holidays unless the GOLDEN
RETRIEVER is experiencing or due for a heat cycle.
3. The GUARDIAN shall
maintain the “GOLDEN RETRIEVER” at a proper weight at all times.
Failure to maintain a reasonable weight (as determined) by a
veterinarian shall null and void this agreement the BREEDER
shall have the right to repossess the “GOLDEN RETRIEVER”. In
such an event every opportunity shall be given the GUARDIAN to
correct the weight problem, as well as a Veterinary diet, if
necessary.
4. The GUARDIAN agrees to feed a high quality wheat and corn
free or to feed a balanced fresh Raw diet and to follow the
BREEDER’s directions for feeding during pregnancy or after
weaning. If supplements are required they will be provided at
the breeders expense.
5. If any part of this agreement is violated it shall be grounds
to return the initial deposit, repossess the “GOLDEN RETRIEVER”
and to null and void the agreement.
6. Purchaser and guardian agreement as follows-
Once the female dog has 2 litters then the female will be spayed
and signed over
To the GUARDIANS. BREEDER WILL PAY FOR SPAYING THE FEMALE
AFTER HER SECOND AND LAST BREEDING.
